SMS MessagingTerms & Conditions(Customer Support & Service Outage Alerts)

These SMS Messaging Terms & Conditions (“SMS Terms”) govern text messaging between you and Structured, Inc (“Structured,” “we,” “us,” “our”) using SMS/MMS. By sending a text message to us, and/or by receiving service outage notifications by text at the mobile number you have provided to us for account/service contact purposes, you agree to these SMS Terms and our Privacy Policy located at: structured-inc.com/
If you do not agree, do not communicate with us by text message.
1) Program Purpose (No Marketing)
Structured’s SMS messaging is used only for:
- Customer support / customer care communications (responding to your inquiries), and
- Service outage notifications, restoration updates, and related operational/service status messages.
We do not use SMS for advertising, marketing, promotions, or sales.
2) Enrollment/ Consent
Customer support texting: If you text us, you consent to receive text messages from Structured in response to your inquiry and as reasonably necessary to provide support.
Outage alerts (automatic): If you are a customer of Structured and you have provided us a mobile number, Structured may send automatic SMS notifications about service outages and restoration updates to that mobile number, subject to applicable law.
Consent is not a condition of purchase. You represent that you are the account holder or authorized user of the mobile number provided and that you have authority to receive messages at that number.
3) Message Frequency
Message frequency varies and depends on:
- Your customer service interactions, and
- The occurrence, severity, and duration of service outages.
4) Costs/ Carrier Charges
Message and data rates may apply. Your mobile carrier may charge you for sending or
receiving SMS/MMS messages. Charges are billed by and payable to your carrier.
5) Carriers & Delivery Disclaimer
Wireless carriers are not liable for delayed or undelivered messages. Message delivery depends
on your mobile carrier, device, network availability, and other factors outside our control.
6) Opting Out
You can stop receiving text messages from us at any time by replying STOP to any message.
After you reply STOP, you may receive one final message confirming your opt-out.
If you opt out, we may still contact you through other channels (phone/email), and you can
continue to access support via:

By using SMS with us, you acknowledge:
- We use your mobile number and message content to provide customer support and service outage notifications.
- We may use third-party service providers (such as messaging platform providers and telecom partners) to deliver and manage messages.
- We may retain message content and related records for customer support, quality assurance, operational needs, compliance, and legal obligations.
- We may disclose information if required by law or to protect the rights, safety, and
security of Structured, our customers, and the public.
We do not send SMS marketing messages and do not use SMS for sales solicitations.
9) Appropriate Use
You agree not to use SMS to send unlawful, abusive, harassing, threatening, or fraudulent content. Please do not send sensitive information via SMS (for example, passwords or highly sensitive personal data), as SMS may not be secure in all circumstances.
Structured may limit or end SMS communications with any number that sends inappropriate
content or that we reasonably believe is used for unlawful or abusive purposes.
10) Service Limitations / No Emergency Use
SMS messaging is not guaranteed to be available, timely, or secure. Do not rely on SMS as the sole method for time-sensitive or emergency communications.

11) Changes to These SMS Terms
We may update these SMS Terms at any time by posting an updated version on this page and changing the “Last Updated” date. Your continued use of SMS messaging with Structured after changes become effective constitutes your acceptance of the updated SMS Terms.
12) Disclaimer of Warranties
The SMS program is provided on an “as is” and “as available” basis. Structured does not guarantee message delivery or message timeliness.
13) Limitation of Liability
To the maximum extent permitted by law, Structured will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to SMS messaging. To the extent permitted by law, Structured’s total liability related to SMS messaging will not exceed US$100.
Some jurisdictions do not allow certain limitations. In those jurisdictions, these limitations apply
to the fullest extent permitted by law.
14) Governing Law
These SMS Terms are governed by the laws of the Commonwealth of Kentucky, without regard to conflict of law rules. Any disputes will be brought in the state or federal courts located in Kentucky, unless applicable law provides otherwise.
